These Terms and Conditions govern your access to and use of JKSmartPay (operated by YourPanth Techservice Private Limited, hereinafter referred to as "Company", "We", "Us", or "Our"). By accessing, registering, booking, or transacting through jksmartpay.in, you agree to abide by the terms outlined below.1. GENERAL TERMS
These Terms and Conditions apply to all users accessing or using the JKSmartPay website, mobile applications, booking services, payment services, wallet services, forex services, remittance services, and other services provided through the Platform.
2. ELIGIBILITY & USER INFORMATION
To use the Services, you must:
Be at least 18 years of age and legally capable of entering into a binding agreement under applicable Indian law.Provide accurate, complete, and up-to-date personal, payment, travel, and KYC information wherever required.
Use the Platform only for lawful purposes.
Ensure that all information submitted during registration, booking, payment, KYC verification, or financial transactions is correct.
JKSmartPay reserves the right to refuse service, suspend an account, or cancel a transaction where we reasonably suspect fraudulent, unlawful, unauthorized, or prohibited activity.
3. NATURE OF SERVICES
JKSmartPay acts primarily as an intermediary and facilitator for services provided by third-party service providers, including:Domestic & International tour packages
Customized and fixed group tours
Bus and cab bookings
Train bookings
Flight bookings
Hotel reservations
Forex conversion
International money remittance
Digital wallet and permitted fintech transaction services
JKSmartPay does not own, operate, or control the underlying services provided by airlines, railways, bus operators, cab operators, hotels, tour operators, banks, payment gateways, forex partners, remittance partners, or other third-party service providers.
All such services are subject to the respective service provider's terms, conditions, availability, cancellation rules, refund policies, and applicable laws.
4. THIRD-PARTY SERVICE PROVIDERS
Bookings and transactions made through JKSmartPay may involve third-party service providers.The availability, pricing, schedules, fares, cancellation charges, refund rules, and service conditions of such providers are determined by the respective provider.
For train bookings, applicable rules of IRCTC / Indian Railways shall apply.
For flight bookings, applicable rules and fare conditions of the respective Airline Company shall apply.
For bus, cab, hotel, and tour services, the applicable rules of the respective operator or service provider shall apply.
JKSmartPay shall make reasonable efforts to facilitate bookings and customer support but shall not be responsible for service deficiencies, delays, cancellations, schedule changes, overbooking, or other failures caused by third-party service providers.
5. ACCOUNT REGISTRATION & SECURITY
Certain Services may require the User to create an account and complete identity or KYC verification.You are responsible for maintaining the confidentiality of your:
Login credentials
Passwords
OTPs
PINs
Payment information
Wallet information
Other account security details
You must not share your OTP, password, PIN, or other confidential security information with any third party.
Any unauthorized access or suspicious activity involving your account must be immediately reported to info@jksmartpay.in.
JKSmartPay may suspend or restrict an account where unauthorized, fraudulent, suspicious, or unlawful activity is detected or reasonably suspected.
6. BOOKING & PAYMENT TERMS
All bookings are subject to availability and confirmation by the respective service provider.Prices displayed on the Platform may include the applicable service cost, convenience fees, processing fees, payment gateway charges, and GST, unless otherwise stated.
Payments may be made through available payment methods including:
UPI
Credit Card
Debit Card
Net Banking
JKSmartPay Wallet, where applicable
Payment transactions may be processed through third-party payment gateways and financial institutions.
In case the User's account is debited but the Booking or transaction is unsuccessful, the applicable refund shall be processed in accordance with our Refund and Cancellation Policy.
7. CONVENIENCE & PROCESSING FEES
JKSmartPay may charge convenience fees, service charges, processing fees, payment gateway charges, or other applicable charges for facilitating a Booking or transaction.Unless otherwise required by applicable law or specifically stated in our Refund and Cancellation Policy, such charges are non-refundable.
Any applicable GST or other statutory taxes may also be charged as required by law.
8. CANCELLATION & REFUND
All cancellations, modifications, refund requests, and cancellation charges are governed by the JKSmartPay Refund and Cancellation Policy.Cancellation charges may vary depending on:
Type of service booked
Service provider
Booking conditions
Date and time of cancellation
Fare or package conditions
Non-refundable components
Applicable taxes and charges
Eligible refunds will be processed in accordance with the Refund and Cancellation Policy.
All approved refunds will generally be credited to the original payment method used during the transaction.
Cash refunds are strictly prohibited except where required by applicable law.
9. TOUR PACKAGES
For customized and fixed group tour packages, the applicable cancellation charges and refund amounts shall be determined according to the Refund and Cancellation Policy and the terms communicated at the time of booking.Non-refundable components, including advance hotel payments, visa fees, non-changeable flight tickets, permits, vendor charges, or other expenses already paid to third-party vendors, may be deducted before processing an eligible refund.
Tour itineraries, hotels, transportation, activities, and other components may be subject to availability and operational requirements.
JKSmartPay reserves the right to make reasonable changes to an itinerary where required due to operational, safety, weather, governmental, or third-party service provider circumstances.
10. FINTECH, FOREX & MONEY REMITTANCE
Forex conversion, international money transfers, remittance services, wallet services, and other financial transactions may be provided through authorized or licensed partners and are subject to applicable RBI, FEMA, KYC, AML, and other regulatory requirements.Exchange rates, fees, limits, processing times, and transaction requirements may vary depending on the applicable service provider and transaction type.
Once a forex conversion or money remittance order has been successfully processed and executed, it may not be cancelled, reversed, or refunded except where permitted by the applicable service provider or required under applicable law.
The User is solely responsible for verifying beneficiary details, including:
Bank account number
IFSC code
UPI ID
Wallet ID
Beneficiary name
Other payment or transfer details
JKSmartPay shall not be responsible for losses resulting from incorrect or inaccurate information provided by the User, except to the extent caused by JKSmartPay's own failure to comply with applicable law.
11. KYC, AML & COMPLIANCE
JKSmartPay and its authorized partners may require additional documents or information to comply with applicable Know Your Customer (KYC), Anti-Money Laundering (AML), FEMA, RBI, tax, sanctions, and other regulatory requirements.We reserve the right to delay, suspend, reject, or report a transaction where required or permitted by applicable law or where we reasonably suspect:
Fraudulent activity
Money laundering
Unauthorized transactions
Misuse of financial services
Identity-related issues
Violation of applicable laws or regulations
The User agrees to provide accurate and genuine documents whenever requested for compliance purposes.
12. USER RESPONSIBILITIES
You agree that you shall NOT:Use JKSmartPay for any unlawful or fraudulent purpose.
Use the Platform for money laundering, terrorist financing, or other prohibited activities.
Provide false, misleading, incomplete, or inaccurate information.
Use another person's account, identity, payment method, or financial information without authorization.
Attempt to gain unauthorized access to the Platform, systems, or another User's account.
Interfere with or disrupt the operation or security of the Platform.
Upload or transmit viruses, malware, harmful code, or malicious software.
Resell, sublicense, or commercially exploit the Services without prior written permission from JKSmartPay.
Use the Platform in violation of any applicable law or third-party terms.

Text
Graphics
Images
Website design
Software
Layout
Content
Trademarks
is owned by or licensed to YourPanth Techservice Private Limited and is protected under applicable intellectual property laws.
Users may not copy, reproduce, modify, distribute, publish, sell, license, or create derivative works from Platform content without prior written permission from the Company, except where permitted by applicable law.
14. LIMITATION OF LIABILITY
JKSmartPay acts primarily as a facilitator and intermediary and shall not be responsible for delays, cancellations, schedule changes, overbooking, service deficiencies, or other failures caused by third-party service providers.JKSmartPay shall not be liable for losses arising from:
Incorrect information provided by the User;
Incorrect bank, UPI, wallet, or beneficiary details provided by the User;
Actions or failures of third-party service providers;
Bank or payment gateway failures;
Government restrictions or regulatory actions;
Technical failures beyond our reasonable control;
Natural disasters or other Force Majeure events; or
Unauthorized use caused by the User's failure to protect account credentials.
To the maximum extent permitted by applicable law, JKSmartPay shall not be liable for indirect, incidental, special, or consequential losses.
Our aggregate liability, where applicable, shall not exceed the amount actually paid by the User to JKSmartPay for the specific Booking or transaction giving rise to the claim.
Nothing in these Terms shall exclude or limit any liability that cannot legally be excluded or limited under applicable law.
15. INDEMNIFICATION
You agree to indemnify and hold harmless YourPanth Techservice Private Limited, its directors, employees, officers, affiliates, and representatives against claims, damages, liabilities, costs, and reasonable legal expenses arising from:Your breach of these Terms;
Misuse of the Platform;
Violation of applicable law;
Fraudulent or unauthorized activity by you;
Incorrect information provided by you; or
Violation of any third-party rights.
16. FORCE MAJEURE
JKSmartPay shall not be responsible for any failure, interruption, or delay caused by circumstances beyond our reasonable control, including:Natural disasters
Floods
Earthquakes
Severe weather conditions
Pandemics or epidemics
Government restrictions
Regulatory actions
Strikes
Civil unrest
War or similar events
Power or telecommunications failures
Technical failures
Cyber incidents
Third-party operator cancellations
In such circumstances, cancellation and refund eligibility shall be governed by the applicable Refund and Cancellation Policy and the terms of the relevant Service Provider.
17. PRIVACY & DATA PROTECTION
Your use of JKSmartPay is also governed by our Privacy Policy.We may collect, process, store, and share information necessary to provide Services, process transactions, perform KYC verification, prevent fraud, provide customer support, and comply with applicable legal and regulatory requirements.
Where required, information may be shared with relevant Service Providers, payment gateways, banks, financial institutions, regulatory authorities, or other authorized partners.
By using the Platform, you acknowledge and agree to the processing of your information in accordance with our Privacy Policy and applicable law.
18. THIRD-PARTY LINKS & SERVICES
The Platform may contain links, integrations, or references to third-party websites, applications, payment gateways, and Service Providers.JKSmartPay does not control and is not responsible for the content, availability, security, privacy policies, or practices of third-party websites or services.
Your use of third-party websites or services is subject to the applicable terms and policies of those third parties.
19. SUSPENSION & TERMINATION
JKSmartPay reserves the right to suspend, restrict, or terminate your access to the Platform or any Service where:You breach these Terms;
You provide false or misleading information;
Fraudulent or unauthorized activity is suspected;
You violate applicable laws or regulations;
Your account creates a security or compliance risk; or
Such action is required by law or a regulatory authority.
Termination or suspension shall not affect any rights or obligations that accrued before such termination.
20. MODIFICATION OF TERMS
JKSmartPay reserves the right to modify, amend, or update these Terms and Conditions at any time.Any revised Terms may be published on the Platform with an updated date.
Users are encouraged to review these Terms periodically.
Continued use of the Platform after updated Terms are published may constitute acceptance of the revised Terms, to the extent permitted by applicable law.
21. GOVERNING LAW & JURISDICTION
These Terms and Conditions shall be governed by and construed in accordance with the laws of India.Subject to any mandatory dispute-resolution requirements under applicable law, disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts at Rajkot, Gujarat, India.
